
Three Sixty Plus Terms and Conditions

1. Introduction
These terms and conditions ("Terms") govern the use of images and services provided by Three Sixty Plus, owned and operated by Manjot Singh, and its associated services, including those previously offered under the LensPassions Photography brand. By engaging the services of Three Sixty Plus, you agree to these Terms. Please read them carefully. The official websites for Three Sixty Plus are threesixtyplus.in and threesixtypluss.com.
2. Definitions

"Three Sixty Plus" refers to the business entity providing professional photography, branding, and website design services, including all rights previously associated with LensPassions Photography.

"Client" refers to the individual or entity engaging the services of Three Sixty Plus.

"Images" refer to photographs, visual media, or any other content produced by Three Sixty Plus.
3. Image Usage
3.1. Ownership
Three Sixty Plus retains full ownership of all Images produced during the engagement, whether in digital or printed format. This includes all rights formerly held under LensPassions Photography, as the ownership has merged with and transferred to Three Sixty Plus.
3.2. License to Client
The Client is granted a non-exclusive, non-transferable license to use the Images for personal and non-commercial purposes, such as personal portfolios, social media, and personal prints.
3.3. Commercial Usage
Any commercial usage of the Images is strictly prohibited unless a separate written agreement is reached between Three Sixty Plus and the Client, specifying the terms and compensation for such usage.
3.4. Prohibition on Modifications
The Client or their team is prohibited from creating transparent formats (e.g., PNG or related formats) of the Images without prior discussion and written permission from Three Sixty Plus. Unauthorized usage or modification will result in penalties, as determined by Three Sixty Plus.
4. Period of Usage
4.1. Perpetual License
The Client's license to use the Images is perpetual, meaning there is no time limit for personal and non-commercial use.
4.2. Commercial Usage
The period for commercial usage, if granted, will be specified in the separate written agreement.
4.3. Modification of Usage Time
Three Sixty Plus reserves the right to change the period of usage at any time, with written notice to the Client.
5. Review after 12 Months
The Client and Three Sixty Plus agree to review and potentially amend this agreement 12 months from the date of the photo shoot. This review will ensure the terms remain relevant and appropriate for both parties.
6. Use by Owner
Three Sixty Plus reserves the right to use the Images for self-promotion, marketing, or any other lawful purpose.
7. Use by Other Agencies
7.1. Non-Exclusive License
Images produced by Three Sixty Plus may not be used by any agency without the express written permission of the Client.
7.2. Agency Usage with Client Permission
If an agency wishes to use the Images, they must obtain written permission from the Client.
8. Merging of LensPassions Photography
LensPassions Photography is now merged into Three Sixty Plus. All rights, ownership, and responsibilities of LensPassions Photography are transferred to Three Sixty Plus, as both are owned and operated by the same individual, Manjot Singh.
9. Modifications
Three Sixty Plus reserves the right to modify these Terms at any time, with modifications taking effect upon posting on the official websites threesixtyplus.in or threesixtypluss.com, or through direct communication with the Client.
10. Governing Law
These Terms are governed by the laws of Amritsar Jurisdiction without regard to conflict of laws principles.

By purchasing any service from Three Sixty Plus ("we," "us," "our"), you ("client," "you," "your") agree to be bound by these Terms and Conditions. These terms apply to all services including but not limited to Website Development, E-commerce Development, SEO Services, and Professional Photography. If you do not agree to these terms, do not purchase our services.

## 2. SERVICES OFFERED
### 2.1 Website Development Services
We offer website development services on various platforms including Wix Studio, Shopify, WooCommerce, and custom solutions. All services are provided on a project basis with defined deliverables, timelines, and pricing.
### 2.2 E-commerce Development Services
**Available Plans:**
- **Starter Plan (₹29,999):** Up to 25 products, Wix Studio platform, basic SEO, 1 month support, 7-10 days delivery
- **Advanced Plan (₹99,999):** Unlimited products, Wix Studio platform, custom features, basic SEO, 6 months support, 30-45 days delivery
- **Enterprise/Custom:** Tailored solutions with custom pricing based on requirements
### 2.3 SEO Services
- **Basic SEO (₹4,999):** On-page optimization for 5 pages, basic keyword research, Google setup
- **Professional SEO (₹14,999):** On-page optimization for 15 pages, competitor analysis, local SEO
- **Advanced SEO (₹24,999):** Comprehensive optimization for 30+ pages, link building, 3 months reporting
### 2.4 Additional Services
Photography services, content writing, app integrations, platform migrations, and ongoing support available at additional cost.

## 3. PLATFORM-SPECIFIC TERMS
### 3.1 Wix Studio Platform
Our standard e-commerce plans (Starter ₹29,999 and Advanced ₹99,999) are built exclusively on Wix Studio platform. All pricing, features, and policies are specific to Wix Studio. Different platforms (Shopify, WooCommerce, Magento, Custom) require separate agreements with different pricing structures.
### 3.2 Platform Change Policy
If client requests platform change during or after project initiation:
- New agreement required with revised pricing
- Migration fee of ₹9,999 to ₹29,999 applies
- Wix-specific features may not transfer to other platforms
- Additional development costs will be client's responsibility
- Timeline will be extended

## 4. PAYMENT TERMS
### 4.1 Payment Structure
**Option A - Full Payment:** 100% advance payment before project commencement
**Option B - Milestone Payment:**
- 50% advance payment to initiate project
- 50% balance payment before final delivery/launch
- No work commences without advance payment
### 4.2 GST and Taxes
All prices are exclusive of GST. Goods and Services Tax (GST) at 18% will be charged as applicable under Indian tax laws. Client is responsible for any other applicable taxes.
### 4.3 Payment Methods
Accepted payment methods include Bank Transfer (NEFT/RTGS/IMPS), UPI (Google Pay, PhonePe, Paytm), Credit/Debit Cards, and Online Payment Gateways (Razorpay).
### 4.4 Late Payments
If balance payment is not received as per agreed schedule, project delivery will be held. Interest at 2% per month may be charged on overdue amounts beyond 15 days.

## 5. HOSTING AND DOMAIN
### 5.1 Hosting Services
**Starter Plan:** Wix hosting ₹5,999/year (unlimited bandwidth, 99.9% uptime)
**Advanced Plan:** Premium Wix hosting ₹9,999/year (priority resources, daily backups)
Hosting charges are non-refundable once services activated. First year hosting included in plan price. Renewal required annually to keep website live.
### 5.2 Domain Registration
**Wix Domain:** ₹1,799/year for .com/.in/.co.in extensions
**Client's Domain:** If client provides existing domain access, no domain charges apply and setup is free
Domain registered in client's name and subject to availability. Domain charges are non-refundable once registration completed. Renewal required annually to maintain ownership.
### 5.3 SSL Certificate
Free SSL certificate included with Wix hosting for one year. HTTPS encryption automatic. SSL managed and auto-renewed by Wix platform. No separate SSL charges.

## 6. REFUND AND CANCELLATION POLICY
### 6.1 Non-Refundable Items
The following charges are non-refundable once services activated:
- Hosting services (₹5,999 or ₹9,999 depending on plan)
- Domain registration (₹1,799 if Wix domain used)
- Payment gateway setup charges
- Platform licenses or subscriptions
- Third-party service fees
### 6.2 Cancellation Window
**Starter Plan (₹29,999):** 7-day cancellation window
**Advanced Plan (₹99,999):** 14-day cancellation window
### 6.3 Refund Calculation
If client requests cancellation within allowed window:
- **No work commenced:** Full refund minus non-refundable items (hosting, domain)
- **Work commenced:** Charges apply for days worked at ₹2,999/day, deducted from refundable amount
- **Example (Starter):** 5 days work = ₹14,995 charged; Refund = Total - Non-refundable - Work charges
### 6.4 No Refund on Partial Payments
If only partial payment (e.g., 50% advance) has been received, NO REFUND will be provided under any circumstances. Refunds only available when full payment (100%) has been received.
### 6.5 Post-Cancellation Window
After cancellation window expires (7 or 14 days), absolutely no refunds will be provided regardless of project status or circumstances.

## 7. PROJECT TIMELINE AND DELIVERY
### 7.1 Estimated Timelines
- **Starter Plan:** 7-10 business days
- **Advanced Plan:** 30-45 business days
- **Custom/Enterprise:** As mutually agreed
- **SEO Services:** 7-45 days depending on tier
Timelines commence from date of advance payment receipt and completion of all requirements from client.
### 7.2 Client Delays
Timeline extensions due to client delays (late content, delayed approvals, unclear requirements) will not be considered our responsibility. Project may be paused if client unresponsive for 15+ days.
### 7.3 Rush Delivery
Expedited delivery available at additional cost:
- **50% faster:** Additional 40% of project cost
- **Rush (3-5 days):** Additional ₹5,999 to ₹15,999 depending on complexity

## 8. CLIENT RESPONSIBILITIES
### 8.1 Content and Materials
Client must provide:
- Product information, descriptions, specifications
- High-quality product images
- Logo, brand assets, brand guidelines
- All text content, legal policies
- Payment gateway credentials
- Domain access (if using existing domain)
- Any third-party service credentials
### 8.2 Timely Responses
Client agrees to:
- Respond to queries within 3 business days
- Provide feedback on designs within 5 business days
- Approve deliverables within 7 business days
- Test website functionality before launch approval
### 8.3 Legal Compliance
Client is solely responsible for:
- Legality of products/services being sold
- Compliance with applicable laws and regulations
- Product licenses, certifications, permissions
- Tax compliance, GST registration
- Terms of service, privacy policy, refund policy
- Copyright/trademark compliance of content provided

## 9. INTELLECTUAL PROPERTY
### 9.1 Client's Content
Client retains ownership of all content, product data, images, logos, and materials provided to us. We may use anonymized data for analytics and service improvement.
### 9.2 Website Ownership
Upon full payment, client owns the completed website including all custom code and design elements specific to their project. Platform-specific components (Wix themes, plugins) remain property of respective platform providers.
### 9.3 Our Portfolio Rights
We reserve the right to:
- Display completed projects in our portfolio
- Use project screenshots for marketing materials
- Mention client name in case studies (unless confidentiality requested)
- Share anonymized project metrics and results

## 10. REVISIONS AND MODIFICATIONS
### 10.1 Included Revisions
- **Starter Plan:** 2 design revision rounds
- **Advanced Plan:** 3 design revision rounds
- **Enterprise:** 4 design revision rounds
Revisions must be requested during development phase and relate to original project scope.
### 10.2 Additional Revisions
Beyond included revisions: ₹2,999 per additional revision round
### 10.3 Scope Changes
Changes beyond original project scope (new features, additional pages, different platform) will be quoted separately and require additional payment.

## 11. SUPPORT AND MAINTENANCE
### 11.1 Included Support Period
- **Starter Plan:** 1 month post-launch support
- **Advanced Plan:** 6 months priority post-launch support
### 11.2 Support Scope
Included support covers:
- Bug fixes and technical issues
- Minor content updates (defined limits)
- Payment gateway troubleshooting
- Platform update compatibility
- Email/WhatsApp support
### 11.3 Excluded from Support
NOT covered in free support:
- New feature development
- Design changes or redesign
- Additional product uploads beyond limits
- Third-party service issues
- Issues caused by client modifications
- Hosting/domain renewal
### 11.4 Extended Support
After included support period:
- **Starter:** ₹2,999/month
- **Advanced:** ₹4,999/month
- **Pay-per-incident:** ₹1,999 per request

## 12. SEO SERVICES TERMS
### 12.1 No Guaranteed Rankings
SEO services are performance-based efforts following industry best practices. We do NOT guarantee specific ranking positions, traffic numbers, or conversion rates. Results depend on competition, algorithm updates, website quality, and other factors beyond our control.
### 12.2 SEO Timeline
Typical results visible in:
- Low competition keywords: 2-3 months
- Medium competition: 4-6 months
- High competition: 6-12 months
### 12.3 SEO Non-Refundable
Once SEO work commenced (keyword research, audit, optimization), services are non-refundable. Only exception: Full refund minus ₹499 processing fee if no work done within 7 days of payment.
### 12.4 Monthly SEO Maintenance
Optional ongoing SEO services:
- Basic: ₹2,999/month
- Professional: ₹4,999/month
- Advanced: ₹9,999/month
Cancel anytime with 15-day notice.

## 13. THIRD-PARTY SERVICES
### 13.1 Payment Gateways
We integrate payment gateways (Razorpay, PayU, CCAvenue, etc.) but client is responsible for:
- Gateway merchant account setup and KYC
- Gateway transaction fees (typically 2-2.5% + ₹3)
- Gateway terms compliance
- Refund/chargeback handling
### 13.2 Shipping Providers
Shipping integrations (Shiprocket, Delhivery, etc.) require client's own accounts. We only integrate; client manages shipping operations.
### 13.3 Third-Party Apps/Plugins
Premium apps, plugins, or subscriptions beyond included features are client's expense. We can recommend and integrate but ongoing costs are client's responsibility.

## 14. WARRANTY AND LIMITATIONS
### 14.1 Service Warranty
We warrant that services will be performed professionally using industry-standard practices. Website will function as designed at time of delivery on modern browsers and devices.
### 14.2 Platform Limitations
We are not liable for limitations, bugs, or issues inherent to platforms we use (Wix, Shopify, etc.). Platform terms and limitations apply.
### 14.3 Uptime and Availability
While we target 99.9% uptime, we cannot guarantee 100% availability. Not liable for losses due to downtime, server issues, platform outages, or force majeure events.
### 14.4 Limitation of Liability
Maximum liability limited to fees paid for specific service in question. We are not liable for indirect, consequential, or incidental damages including lost profits, lost data, or business interruption.

## 15. TERMINATION
### 15.1 Termination by Us
We reserve right to terminate services immediately for:
- Violation of these terms
- Illegal activities or prohibited products
- Harassment, abuse, or threats to our team
- Non-payment beyond 30 days
- Misuse of services or resources
- Fraudulent transactions or chargebacks
### 15.2 Termination by Client
Client may terminate with 7-14 day notice during cancellation window as per refund policy. After cancellation window, termination does not entitle refund but client retains delivered work.
### 15.3 Post-Termination
Upon termination:
- Client receives backup of website files within 15 days
- Hosting/domain services discontinued unless renewed separately
- Outstanding payments immediately due
- Client responsible for data migration if needed

## 16. CONFIDENTIALITY
### 16.1 Mutual Confidentiality
Both parties agree to keep confidential information private including business strategies, customer data, pricing, and proprietary information.
### 16.2 Data Protection
We implement reasonable security measures to protect client data. However, client responsible for maintaining backup of critical data.

## 17. DISPUTE RESOLUTION
### 17.1 Governing Law
These terms governed by laws of India. Jurisdiction: Courts of Ludhiana, Punjab, India.
### 17.2 Dispute Process
In case of disputes:
1. Direct negotiation between parties (15 days)
2. Mediation by mutually agreed mediator (30 days)
3. Arbitration under Indian Arbitration Act (if needed)
4. Legal proceedings as last resort

## 18. GENERAL PROVISIONS
### 18.1 Entire Agreement
These terms constitute entire agreement between parties and supersede all prior communications or agreements.
